AbstractThe National Guidelines of State Policy (GBHN) are the state's point of state administration in outlines as a comprehensive and integrated statement of the will of the people. The GBHN is determined by the MPR for a period of 5 years. With the amendment of the 1945 Constitution in which there is a change in the role of the MPR and the president, the GBHN is no longer valid. Empirical data shows that Indonesia is one of the countries composed of various elements that are very pluralistic, whether viewed from tribe, religion, race, and class. This plurality on the one hand can be a huge potential in nation building, but on the other hand is also a potential source for the emergence of various conflicts that lead to the disintegration of the nation. Government is based on constitutional system (basic law) and not absolutism (absolute power is not limited). This constitutional system further confirms that the government in performing its duties is controlled or constrained by constitutional provisions, in addition to other constitutional provisions which are constitutional issues, such as the MPR Tap and the Law.
